pleted, and it being the first finished in said township, it is designated No. 1, and to be known by the name of A. S. TRUSTEES OF SEMINARY FUNDS. By the act relating to county seminaries, approved February 4, 1831, Rev. L. 489, the board of county commissioners is required to appoint a trustee of the county seminary, for the term of one year, who is required to give bond, and take an oath, faithfully to discharge the duties of his office. Such trustee, when appointed and qualified, is authorized to demand and receive all moneys, in the hands of his predecessor, or in the hands of any other person, for seminary purposes, and any officer refusing to pay over the same is liable to an action and a judgment therefor, with ten per cent. damages. He is authorized to loan the funds in his hands and take bond for the amount loaned and the interest thereon, he being responsible for the money so loaned; and as a compensation for his services, he is allowed to retain one per cent. on all moneys which may come into his hands, and no more. It is further provided by the same statute, that so soon as the seminary fund shall amount to the sum of four hundred dollars, in any county in this state, the qualified voters of such county may elect a trustee in each commissioner's district, for the term of three years, who shall also give bond and take an oath for the faithful discharge of the duties of said office. The three trustees so elected and qualified, are made a body corporate and politic, under the name and style of "The Board of Trustees of the County Seminary of ty," subject always to the limitations and directions of the general assembly; and when so organized they are vested with all the right and interest, in the money, bonds, notes, and effects of the county seminary of the proper county, and have power to hold real and personal property for the use of a seminary of learning, to ap. point a clerk, a treasurer, and other officers, and to do W coun other acts necessary for the beneficial exercise of their functions, and are, to all intents and purposes, in their corporate character, the successors of the seminary trustee, appointed by the commissioners, under the foregoing provision. The bond and oath required of the trustee or trustees, under the different provisions of this act, are similar to those of the school commissioner, and trustees of schools; and the duties required of each are so homogenous that a repetition of the forms is deemed unnecessary and useless. : OVERSEERS OF THE POOR. Two overseers of the poor are elected in each township, by the qualified voters residing therein, on the first Monday in April annually. Rev. L. 133. Each overseer of the poor, before entering on the duties of his office, is required to take an oath that he will discharge his duties faithfully and impartially; and when elected and qualified, they are declared to be a body politic and corporate in law, to all intents and purposes; and have perpetual succession, by the name and style of "The Overseers of the Poor of township," and it is their duty to farm out such poor persons as become a public charge, on contracts to be made on the first Monday in May annually. It is provided nevertheless, that the board of commissioners may, in their discretion, make an annual allowance to such poor adult persons as, from their general character, will probably be benefited thereby, equal to the charge of their maintenance. It is also made the duty of the overseers to bind out poor children as apprentices, males until they shall arrive to the age of twenty-one years, and females until the age of eighteen years, and to execute indentures, a duplicate of which is to be deposited with the county recorder, and recorded in a book to be kept by him for that purpose. Rev. L. 380, 1, 2. It is further provided, that the board of commissioners of any county, whenever they may deem it advisable, shall purchase land in the name of the county, and erect such buildings thereon as may be deemed proper, for the support and accommodation of the poor of the county; and so soon as suitable buildings are erected, all persons who have become a permanent charge on the county as paupers are to be removed to such asylum; and such measures shall • be adopted for their support and employment as may be deemed advisable. And the overseers of the poor in the several townships shall, from time to time, as poor persons may become chargeable to their respective townships, have such persons removed to the said asylum. Id. 386. Notice of farming out a pauper. We the undersigned, overseers of the poor of township in the county of do hereby give notice, that on the first Monday in May next, at the dwelling house of , in the said township, we will farm out, to the lowest bidder, at public vendue, a certain pauper named R. C. aged about seventy-five years. April 3, 1832. Report to the county clerk. A. B. We the undersigned, overseers of the poor of township in the county of , do certify that on the first Monday, being the seventh day of the present month, May, after due notice, we farmed out R. C. a pauper, at public vendue, to E. F. he being the lowest bidder, for the sum of fifty dollars for one year. Α. Β. May 15, 1832. C. D. Indenture of a poor boy, by the overseers. This Indenture, made this fifteenth day of May, in the year of our Lord eighteen hundred and thirty-two, between A. B. and C. D. overseers of the poor of township in the county of and state of Indiana of the one part, and E. F. of the county aforesaid of the other part, witnesseth that the said overseers have put, placed, and bound, and do by these presents put, place, and bind G. H. a poor hoy, aged nine years and six months, as an apprentice to the said E. F. to be taught the art, trade, and occupation of a blacksmith which he the said E. F. now uses; and to live with, and serve him the said E. F. as an apprentice tor the term of eleven. years and six months from this date, that is to say, until he the said G. H. shall arrive to the age of twenty-one years, if the said E. F. shall so long live. And the said overseers do by these presents give unto the said E. F. all the right, power, and authority over the said G. H. and his service, during the said term, which by the laws of this state a master has in and over a lawfully indentured apprentice. And the said E. F. in consideration thereof, doth, on his part covenant, promise, and agree to and with the said overseers and their successors in office, and each and every of them, and with the said G. H. that he will teach and instruct the said G. H. as his apprentice or cause him to be well and sufficiently taught and instructed in the art, trade, and occupation of a blacksmith after the best way and manner that he can; and also to teach and instruct the said apprentice or cause him to be taught and instructed to read and write, and train him to habits of industry and morality; and during the term of his apprenticeship, to provide and allow to him sufficient meat, drink, washing, lodging, and apparel, and all other things necessary for an apprentice, during his said term of apprenticeship. And the said E. F. further covenants and agrees to furnish and give to the said apprentice, at the expiration of his aforesaid term of service, two new suits of wearing apparel, worth at least dollars each. The qualified voters in each township are autho rized to elect on the first Monday in April annually, as many supervisors of highways as may be allotted to the respective townships by the board of county commissioners; and in case of failure on the part of the voters to elect such officers, the board of county commissioners, at their next session after such election should have been held, appoint suitable persons, to remain in office till the time of the next annual election.
